Attorney Roger P. Foley discussing Rapper Rick Ross's arrest for Kidnapping
Last week Rapper Rick Ross was arrsted for allegedly kidnapping and beating one of his workers. Facts are slim and all we know is that Ross and his associate allegedly had some problem with a worker on the estate and brought him into the guest room and down a hallway and allegedly pistol whipped the man. The man claims he is injured and can not eat whole food and must drink through a straw. Currently Rick Ross has no bond. He has been denied bond. Why? Because the charge of Kidnapping with Injury in Georgia is a serious felony and the penalties are life imprison or death. Nobody thinks this is a death penalty case but its serious and he has no bond. I discuss the basic differences in the law in Florida and Georgia and what the charges need to change to allow Rick Ross to be released from jail. The most important thing is to have the defendant released while you work on the case. Then you can work to develop the defense theme of the case. Not likely that the Rapper beat the man because he did not cut the rose bush properly or scratched the pain while weed whacking but did Ross Catch him in his house attempting to steal something? The key to bonding out Ross is to have the kidnapping allegation changed to false imprisonment and then to develop the theme of why the person was battered, if it did happen.
